PROTECTED DISCLOSURES ACT, 2000

PROTECTED DISCLOSURES ACT, 2000 (ACT 26 of 2000) This
Act is derived from Part 5 (whistleblower protection) of the Open
Democracy Bill [B67 — 98], which Part was omitted from that Bill to be
dealt with as a separate Act. The Act makes provision for procedures
in terms of which employees in both the public and private sector may
disclose information regarding unlawful or irregular conduct by their
employers or other employees. The Act provides for the protection of
employees from being subjected to an occupational detriment on account of
having made a disclosure which is protected in terms of the Act. Purpose To make provision for procedures in terms of which employees in both the private and the public sector may disclose information regarding unlawful or irregular conduct by their employers or other employees in the employ of their employers; to provide for the protection of employees who make a disclosure which is protected in terms of this Act; and to provide for matters connected therewith.
